VisitBritainTours.com – Terms of Use

1. Acceptance of Terms

By accessing, browsing or using the VisitBritainTours.com website (the "Website"), or by making a booking or reservation through our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms") in their entirety. These Terms constitute a legally binding agreement between you ("User", "Client" or "you") and International Visa Service Sp. z o. o. sp. k. ("Company", "we", "us" or "our"), the operator of VisitBritainTours.com. If you do not agree with any provision of these Terms, you must immediately discontinue your use of the Website. Your continued use of the Website after any amendments to these Terms constitutes your unconditional acceptance of the revised Terms. These Terms apply to all visitors, users, and clients who access or use our services.

2. Use of the Website

You agree to use this Website solely for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Website. You must not use this Website to transmit, distribute, store or destroy material in violation of any applicable law or regulation, or in a manner that may infringe third-party intellectual property rights. Prohibited activities include, but are not limited to: attempting to gain unauthorised access to our systems, using automated tools (such as bots or scrapers) to extract data, engaging in any conduct that disrupts or interferes with the Website's functionality, or posting false, misleading or defamatory content. We reserve the right to suspend or terminate access for any user who breaches these conditions without prior notice and without liability. You are responsible for ensuring your device and network meet the technical requirements for accessing the Website securely.

3. Booking and Reservations

All bookings and reservations made through VisitBritainTours.com are subject to availability and confirmation by the Company. A booking is considered confirmed only upon receipt of written confirmation from us (by email) and after the required deposit or full payment has been received. When making a reservation, you warrant that all personal and payment information you provide is accurate, complete and current, and that you are authorised to use the payment method provided. You accept full responsibility for any booking made under your account or using your details. For group bookings (5 or more persons), additional terms may apply. We reserve the right to decline any booking at our sole discretion. Changes to confirmed bookings are subject to availability and may incur amendment fees. All bookings are made subject to these Terms and the specific tour conditions communicated at time of booking.

4. Payment Terms

Prices displayed on the Website are quoted in Euros (EUR) or Polish Zloty (PLN) as indicated at time of booking. All prices are subject to change without prior notice until a booking has been confirmed. A non-refundable deposit of 20% of the total tour price is required to secure your booking, with the remaining balance due no later than 60 days prior to the tour departure date. For bookings made within 60 days of departure, full payment is required at the time of booking. We accept payment by major credit and debit cards (Visa, Mastercard), bank transfer, and other methods specified on the payment page. All bank transfer fees are the responsibility of the Client. In the event of non-payment by the due date, we reserve the right to cancel the booking and apply cancellation charges as set out in Section 5 below. VAT and applicable taxes are included in the quoted price unless otherwise stated.

5. Cancellation and Refund Policy

All cancellations must be submitted in writing (by email to [email protected]) and will take effect from the date we receive your written notification. The following cancellation charges apply, calculated as a percentage of the total tour price:

  • Within 24 hours of booking confirmation: 5% administrative fee (provided departure is more than 60 days away)
  • More than 30 days before departure: 10% of total tour price
  • 15–30 days before departure: 25% of total tour price
  • 7–14 days before departure: 50% of total tour price
  • Less than 7 days before departure or no-show: 100% of total tour price (no refund)

Refunds, where applicable, will be processed within 14 business days to the original payment method. The deposit component is non-refundable in all circumstances. We strongly recommend that all clients purchase comprehensive travel insurance to protect against cancellation losses.

6. Travel Insurance

We strongly recommend that all clients obtain comprehensive travel insurance prior to confirming a booking. Adequate travel insurance should cover, at minimum: trip cancellation and curtailment, emergency medical expenses and hospitalisation, emergency repatriation and evacuation, personal accident, loss or theft of personal belongings and travel documents, and personal liability. VisitBritainTours.com does not provide or arrange travel insurance on behalf of clients, and the Company shall bear no liability for any losses arising from a client's failure to hold adequate insurance cover. When selecting insurance, please ensure the policy covers all activities included in your chosen tour itinerary, including any adventure or outdoor activities. You are strongly advised to read your insurance policy carefully and contact your insurer if you have any doubts about coverage.

7. Health and Safety

It is the client's responsibility to ensure they are medically and physically fit to participate in the tour(s) booked. Some tours involve physical activity, walking on uneven terrain, boat travel or other activities that may not be suitable for individuals with certain health conditions. If you have any pre-existing medical conditions, disabilities or dietary requirements that may affect your participation, you must notify us at the time of booking. We will endeavour to accommodate your needs but cannot guarantee that all tours are suitable for all clients. All clients must comply with the health and safety instructions provided by our tour guides and partner operators at all times. The Company reserves the right to exclude any participant from an activity or tour if, in the tour guide's professional judgment, that person's participation poses a risk to themselves or other participants. No refund will be given in such circumstances.

8. Liability Disclaimer

To the fullest extent permitted by applicable law, VisitBritainTours.com (International Visa Service Sp. z o. o. sp. k.) shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising from your use of the Website or participation in any tour or travel service, including but not limited to: acts of God or force majeure events (such as natural disasters, pandemics, strikes, war or political unrest); delays, cancellations or changes caused by airlines, accommodation providers or other third-party suppliers; loss of personal property, injury or illness during travel; or any inaccuracies in information provided on third-party websites. Our maximum aggregate liability to any client shall not exceed the total amount paid by that client for the specific booking giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.

9. Intellectual Property

All content published on the VisitBritainTours.com website — including but not limited to text, photographs, graphics, logos, icons, videos, audio clips, data compilations and software — is the exclusive property of International Visa Service Sp. z o. o. sp. k. or its content suppliers, and is protected by Polish and international intellectual property law, including copyright, trademark and database rights. You are granted a limited, non-exclusive, non-transferable licence to access and view the Website content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of our content without our prior written consent. Unauthorised use of our intellectual property may result in civil and/or criminal liability. Any trademarks displayed on the Website are the property of their respective owners.

10. Privacy and Data Protection

We are committed to protecting your personal data and processing it in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (the General Data Protection Regulation — GDPR) and applicable Polish data protection legislation. We collect and process personal data necessary for the performance of the travel services you book, for compliance with legal obligations, and — where you have provided consent — for marketing communications. Full details of the categories of data we collect, the legal bases for processing, your rights as a data subject, and how to exercise those rights are set out in our Privacy Policy, which forms an integral part of these Terms.

11. Governing Law

These Terms of Use and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Both parties submit to the exclusive jurisdiction of the courts of Katowice, Poland, for the resolution of any disputes arising under or in connection with these Terms, unless mandatory consumer protection laws of the client's country of residence provide otherwise. If you are a consumer residing in the European Union, you may also bring proceedings in the courts of the EU Member State in which you reside. Additionally, the European Commission provides an Online Dispute Resolution (ODR) platform, accessible at ec.europa.eu/consumers/odr, which may be used for resolving disputes.

12. Changes to Terms

We reserve the right to amend, update or replace these Terms of Use at any time and at our sole discretion. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify registered users by email. Your continued use of the Website following the publication of revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically to remain informed of any updates. If any change is unacceptable to you, you must cease using the Website immediately. We shall not be liable to you or any third party for any modification, suspension or discontinuation of the Website or any service offered through it. Previous versions of these Terms may be obtained by contacting us directly at the email address set out in Section 13 below.
